We welcome you to Cure Direct Hub where we aim to facilitate you (the “User”) by connecting the User to top-tier hospitals and/or health care clinics located across the United Kingdom, Europe, Middle East and various countries throughout Asia (the “Locations”). We, at Cure Direct Hub, are desirous of ensuring our services, as specified in these terms of use (these “Terms”), meet the User’s requirements. In this regard, it is imperative that the User carefully peruses these Terms as the same shall constitute as a valid and binding agreement being entered into by us and the User. These Terms consist of clauses which shall be interpreted and construed in the English Language and shall be applicable on all User’s who utilize our services.

II. SERVICES

The services which we intend to offer inter alia include:

• connecting the User, and facilitating such connection, with recognized top tier hospitals §and/or health care clinics in the Locations, wherever the User is desirous of availing medical services
• ensuring that the User’s requirements as per its medical needs are met by undertaking a thorough understanding from the User itself of its needs;
• facilitating introductions between the hospitals in the Locations and the User (the “Services”

It is pertinent to highlight that we can only connect the User with hospitals and/or health care clinics which the User specifies to us whilst signing up on our website, which is as follows: www.CureDirectHub.com (the “Website”).

Whilst performing the Services, we have partnered with renowned, qualified and authorized affiliates (“Affiliates”) which shall be assisting us in the provision of the Services. The Affiliates will have the following functions and/or roles: [xx].

Services Which We Do Not Provide

We do not, in any manner or form whatsoever, offer any direct medical services and/or assistance which inter alia includes advice, prescription and/or any other medical related services. It is clarified that we operate, and our Services are limited to, as a medical tour facilitator in all aspects and respects. We do not, either partially or wholly, directly or indirectly, recommend, sponsor, favor, endorse or vouch for any hospital and/or health care facility in the Locations. We undertake that all hospitals and health care clinics listed on the Website have been thoroughly reviewed by us and stringent due diligence has been carried out by us and the Affiliate in order to provide the User with the Services as per these Terms. We cannot and will not provide the User with any professional advice, nor carry out or recommend any diagnosis or treatment. All information presented on the Website is on as “as is” basis and we do not intend for it to be construed or interpreted as professional advice being given to the User. The User shall be responsible for researching, inquiring into and procuring information in relation to the hospitals and/or health care clinics in the Locations which become available to the user or the User is desirous of procuring services directly from such hospital and/or health care clinic.

III. THE WEBSITE AND USE

The Website, i.e., www.CureDirectHub.com, and its use thereof is subject and conditional upon these Terms hereof.

The User shall not, under any circumstance, use any automatic device, software, program, process or algorithm to access, copy, control, hack or imitate the Website or any of its contents thereof. Neither the design, structure or layout shall be copied, used or imitated by the User for any personal gain or benefit, or to set up any competing business(es). The User shall not probe into nor attempt to acquire access to the Website’s, or of any Affiliates websites’, main control nor any site which may be connected thereto. The User shall not attempt to trace the information of any other user.

The User understands and undertakes that it does not own the Website and as such is will only use the Website for acquiring the Services being offered.

The User shall not use any software, hardware, device, method, algorithm which disrupts, interferes or creates a disturbance within the Website.

The User shall not use the Website for any activities which are illegal, known to be illegal or for any other purpose which is unlawful, nor to use the Website for any activity, from any jurisdiction, which solicits illegality and neither shall the User attempt to gain access to the Website in order to edit, change, alter, modify, variate any of the data or contents inserted therein.

All consents forms, and others is any, made available on the Website which are in connection with the Services being provided by Cure Direct Hub shall be read, filled out correctly and honestly, by the User at their sole risk. In the event any of the forms made available on the Website require to be downloaded, printed or scanned by the User shall be done at the User’s sole cost and expense.

IV. PRIVACY POLICY

We aim to provide the Services to our users upon the User’s satisfaction that there are several data and privacy protection systems in place which will, to the reasonable extent possible, protect and secure information provided by the User. In this regard, Cure Direct Hub has made available on its Website the “Privacy Policy” which inter alia governs how the User’s data and information (“Data”) will be protected by Cure Direct Hub. Data includes, but is not limited to, all electronic data, information which is inclusive of the User’s personal details, medical details and financial details, if any, provided by the User, with their consent and free will, to Cure Direct Hub by virtue of use of the Website and utilization of Services. It is to be noted that Cure Direct Hub shall transfer details, with the consent of the User, to third party hospitals and health care clinics (the aforesaid is covered in a detailed manner in the Privacy Policy provided on the Website. The User is required to read the terms therein), which is necessary for the purposes of the Services provided by Cure Direct Hub.

Certain e-mails containing information may be exchanged between the Cure Direct Hub and third party hospitals and/or health care clinics and/or Affiliates in order to facilitate and provide the Services to the User. The User understands that such measures are necessary in order to keep track of, provide and record consultations, appointments, communication(s) and all other matters in connection with the Services being offered. We may, at times and if required, utilize and disclose, to permitted parties, details pertaining to the User’s travel and accommodation in order to best offer the Services.

The Cure Direct Hub may, if required, use the contact details provided by the User to provide the User with updates, reminders or for other matters in relation to the Services provided by the Cure Direct Hub.

V. INTELLECTUAL AND PROPRIETARY RIGHTS

All marks, designs, graphic designs, logos, texts, photographs, artwork appearing on the Website (collectively the “Works”) are the sole intellectual and proprietary property of Cure Direct Hub. Cure Direct Hub thus reserves the sole and exclusive right to modify and/or change any of the Works at any given time.

No part of the Website, whether in whole or in part, directly or indirectly, may be copied, republished, reproduced, made publicly available, encoded, translated, or distributed in any way by the User except to the extent of downloading any forms which have been specifically made available by Cure Direct Hub in connection with the Services being offered hereto. In such event, the User shall not copy any information, design, look or content of the forms which may be available nor share or pass the same to any other third-party whomsoever unless and until the express consent of Cure Direct Hub for the same has been procured by the User by way of e-mail.

VI. DISCLAIMERS

The Website and is its use thereof by the User is on as ‘as is’ basis. Cure Direct Hub does not undertake any liability nor does it make any express, implied, oral or written representation or warranty of the genuineness, applicability, quality, fitness or reliability of any of the hospitals and/or health care clinics thereof. Cure Direct Hub shall undertake its best endeavors in order to facilitate and provide the Services to the User, and connect the User with the hospitals and/or health care clinics in the, appropriate and access, Locations as requested or required by the User. Any representation, warranty, guarantee, undertaken prescription, diagnosis or any other related matter provided by any hospital and/or health care clinic and relied on by the User does not, and will not, be the liability nor the responsibility of Cure Direct Hub.

Cure Direct Hub only operates as a facilitator and does not guarantee the accuracy nor the services provided by any hospital and/or health care clinic. Cure Direct Hub additionally does not undertake any responsibility for the protection of the User’s data once the same has been made available to the hospital and/or health care clinic. It is apprised that Cure Direct Hub and the hospitals and/or health clinics, whilst operating and entering into this business venture together, are not responsible nor liable for any willful acts and omissions or gross negligence of one another.

All information made available on the Website is to be construed and interpreted as a guide only and not as undertakings thereof, except to the extent as specifically mentioned in these Terms. In the event the Website gets hacked or is affected by a virus or a breakdown which is beyond the reasonable control of Cure Direct Hub, Cure Direct Hub shall not be responsible for any consequences thereof including any consequential loss(es), direct or indirect loss(es), if any, suffered by the User. The aforesaid includes all force majeure events which are beyond the control of Cure Direct Hub. Cure Direct Hub shall attempt to resolve any such issues however, does not guarantee the same.

The User shall be solely and irrevocably responsible for reading, construing, interpreting and signing all information available on the Website, inclusive of all Terms and Conditions and all policies attached thereto. The User agrees and understands that Cure Direct Hub, to the maximum extent permitted by all applicable laws, does not and shall not undertake any responsibility nor liability for the User’s use or inability to use the Website and the User waives all claims in connection thereto, whether arising in tort, contract, statute, equity or otherwise.

VII. LINKS TO THIRD PARTY SITES

The Website contains links and access to third party sites (“Sites”). In the event the User accesses, or is required to access, the Sites as per the requirements of the Services being offered by Cure Direct Hub, the User shall do so and its own risk and in accordance with the terms of services and conditions, if any, available on the Sites.

The User understands that the Sites are not owned, controlled and are neither the property of Cure Direct Hub and as such, Cure Direct Hub shall be responsible for any loss(es) suffered or incurred by the User in relation thereof.

VIII. LIABILITY AND INDEMNIFICATION

The User undertakes that it shall indemnify Cure Direct Hub, its members, representatives, directors, employees, Affiliates from and against any and all claims, costs, expenses (including reasonable attorney’s fees), damages and losses arising out of or in connection with the use of the Website and the Services including any consultations, transactions and/or facilities availed by virtue of the Services.

The User shall further indemnify Cure Direct Hub in the manner and form as per the above in relation to any and all claims and/or disputes arising out of or in connection with the facilities and/or services being offered or provided by the hospitals and/or health care clinics which the User opts to utilize/be referred to.

This section does not exclude or limit Cure Direct Hub’s liability in the event of loss of life or permanent disability unless the same is caused or accrued by virtue of the services availed by the User from the hospital and/or health care clinic.

IX. GOVERNING LAW AND JURISDICTION

These Terms and all policies incidental and/or required to be read part and parcel with these Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any dispute arising out or in connection with these Terms shall be settled in the manner as specified in the Complaint Redressal Policy.

X. MISCELLANEOUS

These Terms constitute and operate as a valid and binding agreement being entered into by and between the User and Cure Direct Hub. The User’s use of and availing of the Services, including signing up for use of the Services, shall be interpreted as the User and Cure Direct Hub irrevocably entering into agreement as per the abovementioned.

Cure Direct Hub reserves the exclusive right to change, alter, modify, amend, variate and/or insert or delete any of the terms contained herein. The User is required to periodically and wherever applicable visit these Terms in order to remain apprised of the same. Cure Direct Hub may, however it is not required to do so, inform the User of the same by way of e-mail or any other contact information made available to Cure Direct Hub by the User.

The User may be required to develop a specific and special username and password in order to access the Website. It is the User’s responsibility to ensure the confidentiality of the username and password selected. The user agrees to notify Cure Direct HuU immediately of any unauthorized use of the user’s account or password, or any other breach of security with the user becomes aware of or anticipates.

The User understands that all payments required to be made to Cure Direct Hub will be collected via a third-party, or in the mode and manner as determined by Cure Direct Hub and as available on the Website. Details of the third-party shall be made available to the user at the time when payment is due and collectable.
